All
agreements for hire of items from "Little Ironies" are
subject to the following terms and conditions (the "Terms and
Conditions"), which shall form part of and govern the contract
of hire.
In these Terms
and Conditions 'Hirer' means the person, firm, company or any other
entity that hires or requests to hire any item or items from Little
Ironies.
Little Ironies
may change these Terms and Conditions without notice to the Hirer
in relation to future orders.
No contract
exists between the Hirer and Little Ironies for the hire of any
items until Little Ironies has received an order form signed by
the Hirer, accompanied by the booking fee (the "Booking Fee")
and Little Ironies sends confirmation of the order in writing or
by email to the Hirer at the address or email address supplied to
Little Ironies by the Hirer.
The hire charges
are those specified in Little Ironies' current hire price guide
or on its website at the time the order form is received by Little
Ironies or, as otherwise notified to the Hirer in writing by Little
Ironies.
Little Ironies
may agree to deliver hire items and delivery charges are available
on request. All deliveries of hire items will be made to the nearest
point of discharge at the delivery location unless otherwise agreed
in writing by Little Ironies. A labour charge will be made for any
further sub deliveries and for setting up or dismantling items.
The Booking
Fee shall be £50, or such other amount as may be notified
to the Hirer by Little Ironies. The Booking Fee shall be deducted
from the hire charges and any delivery charges payable to Little
Ironies by the Hirer. The Booking Fee is non-refundable in circumstances
where the Hirer cancels the booking.
The Hirer shall
be invoiced in respect of the hire charges, and where applicable
delivery charges (less any Booking Fee paid by the Hirer) approximately
14 days before the Time of Delivery specified on the order form.
Payment in respect of the outstanding balance of the hire charges
and delivery charges must be received by Little Ironies in cleared
funds at least 3 days prior to the Time of Delivery specified on
the order form.
The Hirer shall
be required to make payment of a deposit of £100, or such
other amount as may be notified to the Hirer by Little Ironies (the
" Deposit"). The Deposit will be requested by Little Ironies
approximately 14 days before the Time of Delivery. Payment of the
Deposit must be received by Little Ironies in cleared funds at least
3 days prior to the Time of Delivery. The Deposit shall be returned
to the Hirer upon confirmation by Little Ironies that all hire items
and any packaging supplied with the hire items have been returned
undamaged.
The hire charges
are calculated by reference to the period from the Time of Delivery
to the Time of Collection. In the event that any, or all hire items
are not returned to Little Ironies by the Time of Collection, Little
Ironies shall be entitled to charge the applicable hire rates for
the next consecutive period of 24 hours following on from the Time
of Collection (and for each subsequent period of 24 hours thereafter)
in respect of each hire item not returned. Hire charges shall continue
to accrue until such time as either all hire items are returned,
or Little Ironies receives payment in full in respect of the replacement
value of any hire item not returned. Substitutes for lost or broken
hire items will not be accepted. The replacement value for hire
items are shown in Little Ironies hire price guide, current at the
time the order form is received by Little Ironies.
In the event
that Little Ironies believes any, or all, hire items to have been
irreparably damaged during the hire period, Little Ironies shall
be entitled to charge the applicable hire charges for the next consecutive
period of 24 hours following on from the Time of Collection (and
for each subsequent period of 24 hours thereafter) in respect of
each hire item irreparably damaged, until such time as Little Ironies
receives payment in full of the replacement value of each hire item
so damaged.
In the event
that any hire items are returned in a condition other than that
in which they were received by the Hirer (subject to fair wear and
tear), a charge for cleaning, reconditioning, renewing or replacing
will be made where considered necessary by Little Ironies and such
charge shall be deducted from the Deposit.
Little Ironies
shall be entitled to retain the Deposit in whole or in part in respect
of costs incurred by it through loss, or damage to all or any hire
items or packaging during the hire period or in respect of any payments
due to it by the Hirer under the contract which remains unpaid.
In the event that any further sums in excess of the retained Deposit
are due to Little Ironies, the Hirer shall make payment to Little
Ironies in respect of such sums on request.
Should the Hirer
wish to cancel or amend the hire terms, notification must be given
to Little Ironies at least 48 hours before the Time of Delivery,
and Little Ironies reserves the right to make a cancellation charge
where applicable. Little Ironies will endeavor to comply with any
amendments to the hire terms which are notified to it at least 48
hours before delivery.
Little Ironies
will take every precaution to ensure that hire items are clean,
and in good condition prior to delivery.
In the event
of heavy demand for hire items, or on the occurrence of circumstances
beyond Little Ironies' reasonable control, Little Ironies reserves
the right to substitute any hire items and will use reasonable endeavour
to discuss any substitution with the Hirer prior to the Time of
Delivery.
All hire items
and any packaging supplied with hire items remain the property of
Little Ironies, and the Hirer shall so far as he lawfully can assist
Little Ironies to regain possession of any hire item and/ or any
packaging supplied on expiry of the hire period.
Little Ironies
retains the right to uplift the hire items at the Hirer's cost at
any time should the Hirer contravene any of these Terms and Conditions
and the Hirer by acceptance of these Terms and Conditions obliges
himself to give access to Little Ironies for that purpose.
All hire items
are supplied for indoor use only and solely for decorative purposes.
The Hirer will be charged in respect of any damage to hire items
arising through damp or wet. The Hirer should in his own interest
insure, or meet the premiums for insurance of, the hire items during
the hire period. Details will be provided on request.
Where hire items
are being transported by the Hirer or a third party appointed by
the Hirer, the Hirer shall be responsible for all damage to, or
loss of, hire items in transit and shall indemnify Little Ironies
in respect of any such damage or loss.
Where hire items
are to be collected by Little Ironies or any third party on the
instructions of Little Ironies, the Hirer shall ensure safekeeping
of the hire items pending collection.
The Hirer must
check hire items on delivery, and any deficiencies or damage must
be reported immediately to the Little Ironies.
The Hirer is
wholly responsible and shall indemnify Little Ironies for all damage
to or loss of hire items or packaging occurring during the hire
period.
Hire items may
be provided to the Hirer in specialist packaging. The Hirer is required
to retain the packaging during the hire period. Where the hire items
are to be delivered to a venue or other third party premises the
Hirer is advised to ensure that there is available storage space
for the packaging. Little Ironies will provide information on request,
regarding the approximate storage space required for packaging.
If deliveries
are made within the Hirer's or third parties premises Little Ironies
will accept no responsibility and will not be liable for any damages
or loss resulting to the Hirer's or third parties' property. Little
Ironies will not be liable for any indirect or consequential losses
related in any way to the hire items supplied.
Claims for refunds
after completion of the hire period on the grounds that some of
the hire items were not used cannot be considered.
These Terms
and Conditions are effective from October 2010. In the event of
any dispute, English law will apply.
